The General Inspectorate for Immigration had to reverse its decision to revoke the visa of a Filipina nanny who was to be deported, after the woman's employer won her case in court.<\/span><\/p>\n The shortage of foreign labor is a real problem, which unfortunately we are struggling to cope with. The controversial case of the Filipina nanny that \"Adev\u0103rul\" reported about in a previous article was settled in court, where the foreign employee won her case against the Romanian authorities. Thus, the General Inspectorate for Immigration had to reverse its decision to revoke the visa of the Filipina nanny, who was to be deported, after her employee decided to fight for the right of residence of the woman who had practically become part of her family.<\/span><\/p>\n ,,From August until now we have been extremely stressed. The first step that gave us a little bit of hope was when the IGI portal showed an appointment for the physical submission of the file on October 19, when the deportation decision should have been published on the portal of the institution. Unfortunately, I believe that there is not very good communication between the IGI departments, because it was only yesterday, when the deportation decision was physically submitted, that the deportation decision was also published. Only in court could this deportation decision be annulled. Based on this decision, the lawyers attached this information to the file, which strengthened our case.<\/i>l.\", said Alexandra Craina, employee of Almei Caballero.<\/p>\n An emotional rollercoaster worthy of horror movies has unfolded in recent months since the family whose children were in the care of the nanny in the Philippines found themselves at home with IGI, who came to pick up Alma Caballero on the grounds that she was working illegally. Frustration for the employer, the nanny and the recruitment agency Work from Asia, which brought Alma Caballero to the country, reached a fever pitch when the authorities' inability to process the paperwork in time cost them all time, money and a mountain of emotions.<\/p>\n ,,This whole period was extremely stressful, because I understood that now the paperwork to get her work permit reinstated if I sent her to the Philippines, takes 6-8 months. This left me in an impossible situation as I am working and I also have two children. My children are very attached to her. The nanny in turn was very stressed, she couldn't sleep for a while and yet she was very nice to the little ones, but her thoughts were on her unstable situation...She didn't know if she would have any income in the next period. We paid everything, taxes to the state, followed all the procedure, her contract is still active, registered with REVISAL, everything completely legal.<\/i>\"added Alexandra Craina.<\/p>\n The Filipina had applied to renew her license<\/strong><\/p>\n Alma Caballero's case is a lucky one only in the eyes of her employer, who decided to stay with the Filipina nanny and not to give up her services, according to the IGI's decision, which in no way provided for the details of the foreign employee's fate, where and how she should live from that moment on and with what resources.<\/p>\n In short, Almei Caballero's residence permit was issued on August 3, 2021 and expired on August 3, 2022, with paperwork for renewal filed on July 19, 2022. The IGI did not call her, however, because they were extremely overcrowded and could not cope with the heavy workload due to understaffing, as the Filipina nanny's employer, the Filipina nanny, told \"Adev\u0103rul\" in the summer.<\/p>\n At the time, Yosef Gavriel Peisakh, general manager of the recruitment agency Work from Asia, said about the situation,The IGI fined and issued a departure order to a foreign worker in a completely shocking manner. When the procedure dictated by the authorities was followed to the letter, the result defies legality. What is more, they issued an order requiring the employee to leave the country within 15 days, and the employer was fined 10,000 lei. All this while Ms. Caballero has a registered employment contract, but due to the lack of resources faced by the authorities, they invoked the reason that the employee would be working illegally in Romania. Completely false and outrageous<\/i>.\"<\/p>\n 10,000 lei fine<\/strong><\/p>\n Today, Alexandra Craina's fight is not over, as she still has to sort out the fine she received.<\/p>\n ,,On November 17 we have another trial, in which I challenged my fine of 10,000 lei.
